TERMS AND CONDITIONS

1. Binding Agreement

To enter the Leaderboard, you must agree to these Official Leaderboard Rules, which incorporate by reference the provisions and content of the Leaderboard Website and any Specific Leaderboard Rules above (collectively, the "Rules"). Please read these Rules carefully before registering to ensure you understand and agree. You further agree that submission of an entry in the Leaderboard constitutes agreement to these Rules. You may not submit an entry to the Leaderboard and are not eligible to receive the prizes associated with this Leaderboard (“Prizes”) unless you agree to these Rules. These Rules form a binding legal agreement between you and the Leaderboard Sponsor with respect to the Leaderboard.

2. Sponsor & Hosting Platform

The Leaderboard is sponsored by Leaderboard Sponsor named above. The Leaderboard is hosted on behalf of Leaderboard Sponsor by Artmeet Platforms Sdn Bhd (“Artmeet”). Artmeet is an independent contractor of Leaderboard Sponsor, and is not a party to this or any agreement between you and Leaderboard Sponsor (unless the Leaderboard is hosted by Artmeet). You understand that Artmeet has no responsibility with respect to selecting the potential Leaderboard winner(s) or awarding any Prizes. Artmeet will perform certain administrative functions relating to hosting the Leaderboard, and you agree to abide by the provisions relating to Artmeet under these Rules. As a Artmeet.my account holder and user of the Artmeet Leaderboard platform, remember you have accepted and are subject to the Artmeet's Terms of Service in addition to these Rules.

3.Leaderboard Period

For the purposes of Prizes, the Leaderboard will run from the Leaderboard Start date and time to the Leaderboard End date. The Leaderboard Timeline is subject to change, and Leaderboard Sponsor may introduce additional hurdle deadlines during the Leaderboard Period. Any updated or additional deadlines will be published on the Leaderboard Website. It is your responsibility to check the Leaderboard Website regularly to stay informed of any deadline changes. YOU ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE IN YOUR LOCATION.

4. Eligibility:

To be eligible to enter the Leaderboard, you must be:

(i) a registered account holder at Artmeet Malaysia (www.artmeet.my)
(ii) 18 years old and above
(iii) not a resident of Crimea, Cuba, Iran, Syria, North Korea, or Sudan;
(iv) not against the eligibility that stated by the Sponsor

The Leaderboard Host reserves the right to verify eligibility and to adjudicate on any dispute at any time. If you provide any false information relating to the Leaderboard concerning your identity, residency, mailing address, telephone number, email address, ownership of right, or information required for entering the Leaderboard, you may be immediately disqualified from the Leaderboard.

5. Entry Method

Participants, either as an individual [“Single”] may submit their entries via Artmeet Leaderboard Website only [“Entries”] and share to either on Instagram or Facebook.

To submit Entries, Participants are required to:

Step 1: Design artwork with the requirements stated in the Criteria.
Step 2: Upload the artwork on the Artmeet Leaderboard Website.
Step 3: Share the submission to Participants’ own social media such as Facebook or Instagram
Step 4: Must include the hashtags #HappyBirthdayArtmeet, #Artmeet3rdBirthday and #Artmeet in the caption.
Step 5: Make sure successfully tagged @myartmeet on Facebook or Instagram in the caption
Step 6: Make sure you have set your social media account as 'PUBLIC ' in the Settings throughout the competition.

The Leaderboard Sponsor shall have the right to automatically disqualify Entries that did not complete all steps above.

Participants may submit only one [1] Entry throughout the Leaderboard Period. All Entries uploaded by the Participants must be through the Participants’ own personal accounts either Facebook or Instagram accounts. Entry submissions through non-personal Facebook or Instagram accounts are strictly not allowed and shall be rejected by the Leaderboard Sponsor. All Entries must be uploaded to their personal Facebook or Instagram on or before 23:59:59, 19 March 2023. All Entries received outside the Leaderboard Period will be automatically disqualified.

The Leaderboard Sponsor shall have the right to automatically disqualify Entries that do not comply with any of the conditions set out in the Terms & Conditions. The Leaderboard Sponsor shall have the exclusive right to use and publish the contents submitted by the Participants for publication purposes, without any further notice to the Participants.

6. Artwork Submission & Requirements

You can submit your artwork from the Leaderboard Start date until the Leaderboard End date. Your Submissions must be made in the manner and format, and in compliance with all other requirements, stated on the Criteria. Submissions must be received before any Submission deadlines stated on the Leaderboard Website. Submissions not received by the stated deadlines will not be eligible to receive a Prize.

Submissions are void if they are in whole or part illegible, incomplete, damaged, altered, counterfeit, obtained through fraud, or late. Leaderboard Sponsor reserves the right to disqualify any entrant who does not follow these Rules, including making a Submission that does not meet the Requirements.

7. Criteria

Theme: Celebrating Artmeet's 3rd Birthday

All Entries should design based on the following criteria:

Design the birthday card according to the template provided.
Included one or more birthday celebration elements in the design.
Include purple or lavender color in the design.
Include the word "Happy Birthday" in the design.
Not Included sensitive elements such as political, racism, bias and gender discrimination etc.
Submission artwork size must be in a 4:3 aspect ratio or maximum 1024×768 pixels.
Submission artwork in the format of png/jpg/jpeg only.

The Leaderboard Sponsor shall have the right to automatically disqualify Entries that do not comply with any of the conditions set out in the Terms & Conditions.

8. Public Voting

The Public Voting Period is followed by the Leaderboard Timeline.

After submission, The Participant(s) are encouraged to share Entries URL from the Leaderboard Website with friends and family in order to get higher votes. Facebook or Instagram Likes are NOT valid votes. Only Votes on Leaderboard Website are COUNTED as valid votes.

The top 10 Entries with the highest number of votes will win Prizes.

9. Notification of Winners & Disqualification

The winner(s) will be notified by email.

If a potential winner (i) does not respond to the notification attempt within one (1) week from the first notification attempt or (ii) notifies Artmeet within one week after the Submission Deadline that the potential winner does not want to be nominated as a winner or does not want to receive a Prize, then, such potential winner will not receive any Prize, and an alternate potential winner will be selected from among all eligible entries received based on the Leaderboard’s judging criteria.

In case (i) and (ii) above Artmeet may disqualify the participant. Leaderboard Sponsor reserves the right to disqualify any participant from the Leaderboard if the Leaderboard Sponsor reasonably believes that the participant has attempted to undermine the legitimate operation of the Leaderboard by cheating, deception, or other unfair playing practices or abuses, threatens or harasses any other participants, Leaderboard Sponsor or Artmeet.

A disqualified participant may be removed from the Leaderboard leaderboard, at Artmeet's sole discretion. If a Participant is removed from the Leaderboard Leaderboard, additional winning features associated with the Artmeet Leaderboard platform, for example Artmeet medals, may also not be awarded.

The final leaderboard list will be publicly displayed at Artmeet.my. Determinations of Leaderboard Sponsor are final and binding.

10. Prizes

The prizes to be won throughout the Leaderboard as shown below:

Top Tenth [10] Prizes in the form of RM100 cash each

Each Participant can only win one [1] Prize throughout the Promotion Period.

All Prizes will be couriered to the Winners within 6 – 8 weeks when the Winners’ announcement is made. The Leaderboard Sponsor will not be held liable in the event of non-receipt or delayed delivery of the prizes. The Leaderboard Sponsor reserves the rights to extend the timelines stated under this clause owing to reasons beyond the control of the Leaderboard Sponsor. All unclaimed prizes after the deadline set by the Leaderboard Sponsor for prize collection will be forfeited.

The Leaderboard Sponsor retains the right to substitute any prize with another prize of similar value in the event the original prize offered is not available. The Leaderboard Sponsor excludes its responsibilities and all liabilities arising from any postponement, cancellation, delay or changes or modifications to the Leaderboard or prizes or due to any other unforeseen circumstances beyond the Leaderboard Sponsor’s control such as governmental interference, civil commotion, riot, war, strikes, act of terrorism (including but not limited to any act of violence, hostility, national emergency, occurrence of any epidemic/pandemic outbreaks) and for any act or default by any thirdparty suppliers or vendors.

All Prizes are subject to Leaderboard Sponsor 's review and verification of the participant’s eligibility and compliance with these Rules, and the compliance of the winning Entries with the Entries Requirements. In the event that the Entries demonstrates non-compliance with these Leaderboard Rules, Leaderboard Sponsor may at its discretion take either of the following actions: (i) disqualify the Entries; or (ii) require the potential winner to remediate within one week after notice all issues identified in the Entries.

11. Taxes

ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. Payments to potential winners are subject to the express requirement that they submit all documentation requested by Leaderboard Sponsor or Artmeet for compliance with applicable state, federal, local and foreign (including provincial) tax reporting and withholding requirements. Prizes will be net of any taxes that Leaderboard Sponsor is required by law to withhold. If a potential winner fails to provide any required documentation or comply with applicable laws, the Prize may be forfeited and Leaderboard Sponsor may select an alternative potential winner.

12. Publicity

You agree that Leaderboard Sponsor, Artmeet and its affiliates may use your name and likeness for advertising and promotional purposes without additional compensation, unless prohibited by law.

13. Copyright Attribution

By participating in the Leaderboard, you understand and agree the copyright of the Submission belongs to the Sponsor unless otherwise.

14. Portfolio Attribution

You have the right to showcase your submission as your portfolio after the end of Leaderboard.

15. Privacy

You acknowledge and agree that Leaderboard Sponsor and Artmeet may collect, store, share and otherwise use personally identifiable information provided by you during the Artmeet account registration process and the Leaderboard, including but not limited to, name, mailing address, phone number, and email address (“Personal Information”). Artmeet acts as an independent controller with regard to its collection, storage, sharing, and other use of this Personal Information, and will use this Personal Information in accordance with Artmeet's Privacy Policy, including for administering the Leaderboard. As a Artmeet.my account holder, you have the right to request access to, review, rectification, portability or deletion of any personal data held by Artmeet about you by logging into your account and/or contacting Artmeet Support.

As part of Leaderboard Sponsor performing this contract between you and the Leaderboard Sponsor, Artmeet will transfer your Personal Information to Leaderboard Sponsor, which acts as an independent controller with regard to this Personal Information. As a controller of such Personal Information, Leaderboard Sponsor agrees to comply with all Malaysia and foreign data protection obligations with regard to your Personal Information. Artmeet will transfer your Personal Information to Leaderboard Sponsor in the country specified in the Leaderboard Sponsor Address listed above, which may be a country outside the country of your residence. Such country may not have privacy laws and regulations similar to those of the country of your residence.

16. Warranty, Indemnity and Release

You warrant that your Submission is your own original work and, therefore, you are the sole and exclusive owner and rights holder of the Submission. At the same time, you also warrant that the work you submit does not infringe the copyrights of other authors. If there is any infringement, you will be responsible for yourself, and all criminal responsibility will be independent of Artmeet.

17. Right To Cancel, Modify or Disquality

If necessary, Artmeet reserves the right to cancel, modify the Leaderboard or disqualify the participants without prior notice.
